Netflix Settles ‘Queen’s Gambit’ Defamation Lawsuit With Georgian Chess Master

Netflix agreed on Tuesday to settle a defamation lawsuit with Georgian chess master Nona Gaprindashvili, who had sought $5 million in damages as the result of a “sexist and belittling” representation of her in the Emmy Award-winning series The Queen’s Gambit, which falsely asserted she “never faced men.”

The stock market fell in volatile trading on Tuesday, adding to sharp losses in recent weeks as investors assessed the latest round of better-than-expected economic data, which points to more aggressive interest rate hikes from the Federal Reserve.

Markets initially opened higher after the holiday weekend but soon turned negative despite more strong economic data that showed that the U.S. services sector grew at a faster rate than expected in August.

Combined with a stronger-than-expected jobs report last Friday, the solid economic data has now led investors to bet on the Federal Reserve hiking interest rates more aggressively and for a longer period of time until inflation subsides.

Rates on government bond yields surged, adding pressure to the selloff in stocks as the ten-year Treasury note jumped as high as 3.35%, while the two-year Treasury rose to as much as 3.51%.

The technology and energy sectors led the market declines, with some of the only bright spots Tuesday coming from real estate, utilities and healthcare stocks.

Shares of struggling retailer Bed Bath & Beyond, meanwhile, fell by another 18% after CFO Gustavo Arnal died by suicide over the weekend, with the company announcing an interim appointment on Tuesday.

“Market psychology is very gloomy—whether it’s for fundamental or seasonal reasons, people aren’t all that eager to buy the dip, especially after the failure of Friday’s post-jobs rally (although there isn’t aggressive selling taking place either),” says Vital Knowledge founder Adam Crisafulli.

CVS Health (CVS) announced last night that it has entered into a definitive agreement to acquire leading health risk assessment, provider enablement and value-based care provider Signify Health, Inc. (SGFY) for $30.50 per share in cash, which represents a 44% premium to where SGFY’s stock closed before rumors of a potential takeover began to emerge on August 22 and amounts to a total transaction value of roughly $8 billion. With $12.1 billion of cash at the end of its most recently reported quarter and CVS on pace to generate between $12.5 billion and $13.5 billion in operating cash flow this year alone, the company shouldn’t have any issues funding this transaction. In fact, it’s optimistic in its ability to retain its investment grade credit rating even with the additional leverage this will bring.

Naysayers may be quick to argue that CVS is still paying too much for a company expecting to produce less than $250 million in adjusted EBITDA in 2022. While we agree that the purchase price—which represents a multiple of over 30 times this amount—appears steep at first glance, there are good reasons why SGFY commanded such a price tag and why it was also reportedly being pursued by other heavy hitters like Amazon.com, Inc. and UnitedHealth Group, Inc. Chief among them are Signify’s network of more than 10,000 clinicians across all 50 states, its nationwide value-based provider network, and its proprietary analytics and technology platforms, which will further enhance CVS’s ability to connect patients to care how and when they need it. Specifically, Signify’s network of clinicians—which includes physicians, nurse practitioners and physician assistants—utilize home-based visits to identify a patient’s clinical and social needs, and then connect them to appropriate follow-up care and community-based resources in order for the patient to have a more connected, effective care experience. And as these visits typically average 2.5 times longer than a similar primary care office visit, most patients surveyed felt that such in-home health risk assessments were more convenient and thorough than traditional doctor visits, with 80% of members who have participated in a health risk assessment saying they would have one again.

With Signify’s clinicians expecting to connect with nearly 2.5 million unique members in the home (both in-person and virtually) in 2022, it’s no surprise that CVS expects this deal to be accretive in its first full year following its projected close in the first half of 2023 and generate attractive returns on invested capital over time as synergies are realized. Coupled with the company’s excellent track record with successfully integrating similar potentially lucrative acquisitions, we think this one will also contribute to meaningful gains in share value ahead.

This will be the second post-primary rally from the former president—he held an event featuring Pennsylvania Republican Senate nominee Mehmet Oz on Saturday, whose campaign woes are also of major concern to Republican leaders.

Vance leads Ryan by just 3.7 percentage points, according to the latest RealClearPolitics polling average—well below the 8 points Trump carried the state by in the 2020 presidential election, though polling before that election significantly underestimated Trump’s margin of victory.

Ryan is dominating Vance in fundraising—the Democrat’s campaign said it raised $9.1 million during the second quarter, while Vance only reported $2.3 million in that period.

Vance has come under increasing criticism lately for making very few public appearances, while Ryan has been working the campaign trail hard, pitching himself as a moderate populist that can appeal to Trump voters. Ryan has said he’s a Democrat willing to break with President Joe Biden and party leaders, telling NBC News this summer that “Democrats aren’t right about everything,” even though his House votes have reportedly aligned with Biden’s positions 100% of the time. Republicans have grown so concerned about the race, though, that a super PAC connected with Senate Majority Leader Mitch McConnell (R-Ky.) announced last month it plans to flood $28 million into Ohio to boost Vance’s chances. Putting such a massive investment in a state Republicans have dominated in recent years is emblematic of growing GOP pessimism around the midterms.

Republicans earlier this year were widely expecting a red wave in November that would hand the party control of the House and Senate, but a series of unexpected wins by Biden this summer and the unpopular Supreme Court ruling overturning Roe v. Wade have been setbacks for the GOP. Democrats are now the betting favorites to keep control of the Senate.

Canadian authorities asked residents in an indigenous community in Saskatchewan to shelter in place Tuesday, after receiving reports a suspect allegedly involved in a stabbing spree—which left 10 people dead and at least 18 injured—was spotted in the area, two days after one of the most deadly attacks in the country’s recent history.

Armed Canadian police surrounded a residence on the James Smith Cree First Nation reserve—where some of the stabbings took place—and sent an emergency alert to phones warning the suspect, 30-year-old Myles Sanderson, may have been seen in the area, according to the Associated Press.

Authorities said late Monday they found the body of 31-year-old Damien Sanderson, the other suspect and Myles Sanderson’s brother, outside a house on James Smith Cree First Nation.

The discovery came after authorities charged the pair with murder and other counts in connection to the stabbing attack.

Damien Sanderson’s injuries did not appear to be self-inflicted, and the coroner’s office will determine his cause of death, local officials said.

Police were first notified about a stabbing attack at 5:40 a.m. Sunday in the communities of James Smith Cree First Nation and Weldon, where authorities said suspects may have targeted some victims and stabbed others at random across 13 crime scenes.

The suspects’ motive. A statement from indigenous leaders suggested drugs may have played a role, with the Federation of Sovereign Indigenous Nations, a group representing 74 First Nations in the province, saying the attacks are “the destruction we face when harmful illegal drugs invade our communities,” according to Reuters. Authorities are investigating the relationship between the two suspects and whether they were already known to police.

The attack was one of the deadliest in Canada since a Nova Scotia mass shooting in 2020 that left 22 people dead. The country quickly moved to tighten gun control laws after the massacre.

The two suspects may have gone door-to-door to carry out the attack in the extremely remote location, according to the BBC, citing a local journalist on the scene. Multiple people were flown by helicopter to the province’s main hospital after the attack. James Smith Cree Nation and the village of Weldon are located in central Saskatchewan. Some 2,000 people live on the James Smith Cree Nation reserve, while Weldon has a population of roughly 200 people. The killings come after Canada has faced a reckoning over abuses toward indigenous people, including after mass graves containing the remains of more than 1,000 people, most of whom were children, were found in 2021 at three former residential schools indigenous children were forced to attend. Indigenous people comprise roughly 5% of Canada’s total population, but are twice as likely as non-indigenous Canadians to fall victim to violence, according to the Canadian government.

Juul must also comply with “strict injunctive terms severely limiting their marketing and sales practices,” according to a press release from Connecticut Attorney General William Tong, who led the investigation along with Texas Attorney General Ken Paxton and Oregon Attorney General Ellen Rosenblum.

The investigation found Juul marketed its nicotine products with launch parties, product giveaways, ads and social media posts.

In a statement to Forbes, a company spokesperson called the settlement a “significant part of our ongoing commitment to resolve issues from the past,” and that it is committed to “combating underage use.”

According to Tong, Juul “relentlessly marketed vaping products to underage youth, manipulated their chemical composition to be palatable to inexperienced users, employed an inadequate age verification process and misled consumers about the nicotine content and addictiveness of its products.”

The settlement money will be allocated towards nationwide programs aimed at reducing tobacco use, Tong stated.

The settlement comes nearly three months after the Food and Drug Administration banned Juul vaporizers from the market over claims it did not meet the administration’s standards, which Juul appealed and the FDA suspended; the company is still awaiting a further decision.

Massachusetts became the first state to file a lawsuit against Juul in July 2018, alleging the company illegally advertised and sold nicotine products to minors and “created an epidemic of nicotine addiction among young people.” Juul denied having deliberately marketed nicotine to teenagers, adding its advertisements were aimed at helping adults switch from cigarettes to vaporizers, the New York Times reported, following accusations the company purchased ad space on Nickelodeon, Cartoon Network and Seventeen Magazine. In December 2019, former President Donald Trump signed into law legislation raising the federal minimum age to purchase tobacco products from 18 to 21.

Look for pants made with moisture-wicking, performance fabrics that keep you dry, comfortable and chafe-free. Thicker materials will likely be more durable and warm for cold-weather hiking but may be slower to dry than thinner fabrics, says avid outdoorsman and American Hiking Society author Wesley Trimble. Several Trump-linked operatives were allowed to access a Georgia elections office with help from a local Republican official who was trying to get Trump reelected, according to new surveillance video taken the same day the county’s voting system was breached—the latest twist in the alleged breach of Coffee County’s voting data now under investigation by state and local authorities.

Computer experts from the forensics firm SullivanStrickler were sent by pro-Trump attorney Sidney Powell on January 7, 2021, to the election office in Coffee County, Georgia, where they copied a wide range of data from the county’s voting systems for a reported $26,000 fee, the Washington Post first reported in August.

Cathy Latham, the county’s former GOP chairwoman and one of the Republicans who signed on to a false slate of electors in Georgia, let the operatives into the office that day, according to surveillance video reported by CNN and the Post that was obtained as part of a civil lawsuit over Georgia’s election security.

Former elections supervisor Misty Hampton also told the Post in June she let the operatives into the office to identify potential election vulnerabilities, after uploading a viral video that alleged issues with voting machines, but claimed she did not know whether they accessed the county’s election management system server.

Latham had previously denied being at the office that day in conjunction with SullivanStriker’s visit—though the Daily Beast previously reported text messages showing her involvement in coordinating the effort—and her attorneys told CNN she “was not personally involved in whatever was done.”

Tech consultants Jeffrey Lenberg and Doug Logan—whose firm Cyber Ninjas conducted the widely criticized audit of Arizona’s election results—then made several visits to the Coffee County office in subsequent days, the Post reports, raising further concerns about possible breaches of security.

The files taken from Coffee County were put on a server and downloaded by “at least” four people outside of SullivanStrickler, the Post reported in August, including Logan, cybersecurity consultant Jim Penrose, former pro surfer Conan Hayes and a man known only as “Scott T.”—the latter two of whom were also involved in an alleged voting systems breach in Antrim County, Michigan.

What To Watch For

The Georgia Bureau of Investigation has opened a criminal investigation into the alleged breach of voting data in Coffee County, it told the Post, which is a “computer trespass investigation” regarding the county’s election server. Under Georgia law, knowingly using a computer “without authority” or with the intention to delete, obstruct, alter or damage a computer program or data is a felony offense punishable by up to 15 years in prison or a $50,000 fine. The Fulton County District Attorney’s office has also indicated it’s looking into the Coffee County breach as part of its investigation into former President Donald Trump’s efforts to overturn the election, according to court documents. Latham herself is also under investigation by the Fulton County DA’s office and federal prosecutors as one of the “fake electors,” who assembled false slates of electors in Georgia and other battleground states falsely claiming that Trump had won the state and submitted them to Congress.

Coffee County is one of several counties nationwide where Trump-linked forensics experts allegedly breached voting systems or were given court permission to do so, including multiple counties in Michigan, Nevada, Pennsylvania and Colorado, where Mesa County Clerk Tina Peters was indicted for her role in facilitating the security breach. Michigan is investigating allegations of voting machine tampering in several counties, and Attorney General Dana Nessel requested a special prosecutor to oversee the probe because her Republican opponent in the midterm election, Matthew DePerno, is one of the people who’s under investigation.

What We Don’t Know

Whether the breaches will pose a security risk for future elections. The Cybersecurity & Infrastructure Security Agency warned in June of a security vulnerability involving voting machines from Dominion Voting Systems, which pro-Trump election deniers have targeted and were used in Georgia. The vulnerability can only be exploited with in-person access to the devices, however, which has raised concerns about the pro-Trump forensics experts’ elections office visits. Cybersecurity experts cited by the Daily Beast and the Post said that with voting data being uploaded to servers and viewed by people outside SullivanStrickler, there’s a concern that people could find vulnerabilities in the election systems and share them with hackers who could exploit them and pose a risk to election security.

Coffee County, which Trump carried in 2020 with 69.5% of the vote, was the only county in the state that didn’t certify its election results, CNN notes. The county is one of two referenced in draft executive orders from Trump that would have ordered the Department of Defense to seize voting machines in an effort to challenge the election results, according to CNN, along with appointing a special prosecutor—likely Powell—to oversee the effort. There is no evidence to support allegations of widespread election fraud in the 2020 election or otherwise, but Trump proponents have seized on voting machines and alleged issues with them as a central part of their fraud claims, alleging that machines “flipped” votes from Trump to President Joe Biden. Those allegations have resulted in Dominion Voting Systems and rival company Smartmatic bringing a slew of defamation lawsuits against far-right figures and media outlets, including Powell.
